Possession of Child Pornography

Penal Code 311.1 governs the illegal possession of child pornography. It is punishable as a felony or a misdemeanor. It is illegal to possess, send, prepare, publish, produce, develop, duplicate, or print images, including computer images, of an obscene matter, knowing that the matter depicts a person under age 18 personally engaging or simulating sexual conduct. In addition to the penalty of up to three years in prison, this crime requires lifetime sex registration pursuant to Penal Code 290.
