Identity theft is the fastest growing crime in California, especially in the Bay Area. With the constant improvements in technology, it is easier and easier to commit crimes involving identity theft. Penal Code section 530.5 defines identity theft as any person who willfully obtains personal identifying information of another and uses that information for an unlawful purpose, such as obtaining goods, credit, services, property, etc…without the person’s consent.
Identity theft can be a felony or a misdemeanor. The typical identity theft case can be punished for up to three years in prison.
