Burglary (Residential, Commercial, Vehicle)
Residential burglary occurs when a person breaks into another person’s home, regardless of whether someone is home. If the person is home, the penalties are more severe. Residential burglary carries up to six years in prison and is a “strike” offense under California’s Three Strikes law.
Commercial burglary occurs when a person breaks into a commercial establishment with the intent to commit grand or petty larceny (theft), or any felony, when the value is over $950. This crime carries up to three years in state prison.
Auto burglary is breaking into a locked vehicle and is punishable as a misdemeanor, or as a felony up to three years in state prison.
